Thank You Pat Estelle
Bob,
Maybe you might want to put something in your blog like , Irene Nassor tripped on the sidewalk on 10th St. while walking her dog Ginger. She knew right away that she had broken something. Found out that it was her pelvic. After a stay in the hospital and Healthsouth she is back home and doing well. Pat Estelle jumped at the the opportunity to call all the right people in the county and the new two slabs were poured this morning on the East end of 10th. St. Thanks Pat !!

July 31, 2010 Minutes – Board Of Directors Meeting
1. General – Dick Byram called the board meeting to order at 10:02, followed by the Pledge of Allegiance. Various subjects brought up by each board member were addressed. This portion of the meeting was closed at 10:45. The floor was turned over to the residents present for comments and discussion.
2. Financials - Jean Kay addressed the expenses with the group. A hand written summary of the Catalina Oaks finances were distributed, to those who wanted a copy. Total assets as of July 31, 2010 are $ 121,157.98 (3 CDs at $105,794.99 and 15,362.99 in the checking account). The “Actual versus Forecasted Expenses” revised spreadsheet is posted bellow.
Two out of 52 are in rears on association dues. A form letter demanding payment has been served on one unit. Upon additional discussion it was recommended a registered return receipt letter be sent requesting payment in 30 days, per the bylaws. If the money is not paid then a small claims action or visit with the attorney may be in order.
Dues will be paid on the second home at the time of once the home is sold and it clears escrow, as this has happened on other homes in the community.
3. Minutes - The minutes from the January Meeting were read. Meeting minutes for today’s meetings are included herein and will be posted on the blogspot.
4. Water Retention – The system is working fine. A few repairs were made which caused water to stay in the swale and permeate thru the ground as designed. St Johns Water Management recommended Pat Estelle have her backyard-landscaping cut back to aid in the drainage of water from her property, which she did and it is helping dissipate the water faster. Water became an issue at one point as a result of her neighbor filling in his swale area with additional dirt so water could not accumulate behind his house. The boards’ understanding is that this condition was corrected prior to the house selling.
Pat will get with Robert to resolve a few minor concerns with a lump at the drain between the homes that is part of the drainage system.
A letter from MBV Engineering was received by he board, which stated we were obligated to service the water drainage system 2 times a year at a significant expense to the homeowners. After further review and much discussion with past board members the current board will conduct business as usual and have the system serviced every 2 years, as they have done in the past. The noted letter has been posted to the blog for homeowner review.
5. Pool and fence # 591 – Our president John has been hospitalized due to a stroke. John and is unable to speak for himself. The fence along 6th street and the pool need to be serviced/repaired. The property is being handled by Lynn (Johns relative), who is in the process of cleaning up.
Dick and Pat Byran stopped in at Johns home after the meeting and spoke with Lynn about the items discussed by the board during the meeting. She stated they would be attended to in a timely manner.
6. Unit 542 – The green home you see when you drive in our development has been in the paint process for a long time. The homeowner lives out of state and was discussing paint colors with John, who has suffered a stroke and things fell thru the crack. Dick contacted the homeowner and the homeowner sent in a letter expressing her unhappiness with the architectural review process and Dick. A phone call was made and an email was generated to formalize paint colors and to get the ball rolling again, a few weeks ago. Bob will call and send another email to see if we can move ahead and finish the painting. Reference Article 6 Exterior Maintenance by Association Section 1 and Section 2 page 7.

7. Grounds Maintenance - All is well. The service being provided is getting the job done. The area at the northeast corner at the retention pond needs attention, as it seems to be overgrowing. Dick will mention this to John, at his next visit.

B. Parking on the grass – One blue truck on the grass seems to be the norm at the home at # 550. It has been pointed out to the renters on numerous occasions but the result is the same. The problem goes away for a little bit them comes back again. A notice letter will be sent. Reference - Article Seven Restrictive Covenants Page 9 Section 10 Parking
C. Dog Nuisance – At #550 dogs are let out off the leash and dog waste is not properly disposed off. A notice letter will be sent. Article Seven Restrictive Covenants Page 9 Sections 11
D. A proposal to cut the meetings to twice a year surfaced last year partly due to the lack of attendance at all meetings scheduled by the board. The idea is to have one in January and the second in July. Special informal meetings will be scheduled as required to cover issues that may need attention instead of meetings in April and October.

NRFU coming to YOU in MAY
The Nonresponce Follow-up (NRFU) Team will be going to homes to conduct interviews in person in a few weeks. This means in May you may notice people in your area that are strangers to you.
If you did not get a 2010 Census form in the mail and you did not fill out a questionnaire and the Census folks in Port St. Lucie did not receive a response, your house will show up on the list that NRFU Field Agents will visit.
This person is called an Enumerator. His /her job is to ask you specific questions as listed on the Enumerator Questionnaire (EQ) D1-E form. This EQ helps determine the status of the housing unit (HU) address on Census Day, April 1, 2010.
So lets just say that a stranger shows up at your door. He or she should have a badge hanging from their neck that identifies this person as a Census Worker. They were told to have a photo ID in their position as well. They will also be carrying a black bag with U.S. Census Bureau marked on the side of the bag.
They will have a questionnaire in their hands and a document they will hand you. You will be asked questions about each member of the household. How many people live here? What are their names? When were they born? How old are they? There are a few more questions but in general it should take less than 10 minutes to complete.
Please keep in mind that no assumptions can be made by the enumerator. So when he/she asks if you are male or female just answer the question. If he/she asks if you are Hispanic, Latino….just respond accordingly.
A Notice of Visit will be left on the first visit, if they were not able to make contact with letting you know that they came to your address. The information provided on this form will enable you to call and arrange for a visit when it is convenient for you. The field NRFU agents must try to contact a person in the home, in person 3 times. Three additional attempts can be made by phone, if they have a phone number.
They will talk to neighbors about the HU if they are not able to connect with someone at that address. If they do not reach you after 3 attempts we will conduct an interview with a proxy respondent…your neighbor.
I would also like to mention they would attempt contact during the week, and on the weekends, in the morning, afternoon and at night. Please understand they are doing a job just like a lot of you, so please help them out and be cooperative.
So, if you did not return a 2010 Census Questionnaire you will most likely get a visit from a bureau enumerator. The NRFU enumerators job is to complete an EQ for every case in his or her assignment area, whether the HU was occupied, vacant or not a housing unit on April 1, 2010.

The Role Of Today's HOA
Board Of Directors
To be effective, a homeowners association needs a strong board of directors that understands its role and pursues it with passion and a concise mission in mind. The following outline provides an overview of board roles and responsibilities.
To form an effective board, directors must have a clear understanding of the strengths and weaknesses of the association, its history and what is to be accomplished. Every homeowner association should have responsibility for its assets as well as its operation in accordance with standards established by state and federal law, local ordinances, and the governing documents upon which the entity itself was created. To the extent that the association has such authority and control, it is the board of directors that makes certain these responsibilities are fulfilled.
Understanding the homeowners association concept:
The homeowners association is the cornerstone of a planned residential community. It brings continuity and order to the community, it preserves the architectural integrity and it maintains the common elements. Properly run, the association promotes the concept of “community” and protects the neighborhood's property values. In many cases, it collectively makes available recreational and other facilities that might not otherwise be affordable or available to homeowners and residents on an individual basis.
Deed-initiated homeowners associations have become an essential part of the overall concept of residential property ownership in today's marketplace. Purchase of a home or lot often brings with it mandatory membership in an association which then provides the structure for operation and management of the residential development. With membership comes certain maintenance obligations, financial responsibilities, and a commitment to abide by use restrictions and other rules of the association. To a degree, it necessitates individual conformity for the good of the whole.
The association's responsibilities may be limited to basic maintenance functions or they may be expanded to include sophisticated and extensive upkeep of the property as well as delivery of special services to individual homes (e.g. back door trash pickup). To be successful, its officers and directors must uniformly and fairly govern the community, and it must have a reasonable level of participation by each of its members over time.
Board of Directors
The association has responsibility for its common elements as well as the management and operation of the association's business affairs - - all in accordance with standards established by the governing documents created when the community was first developed. To the extent that an association (typically a non-profit corporation) has such authority and control, it is its board of directors that carries out these duties and responsibilities.
Members of the board of directors of an association serve without compensation unless the bylaws of the association provide to the contrary. The board's authority includes all of the powers and duties enumerated in general law, as long as these powers are not inconsistent with the provisions of the documents governing the association.
Officers of the Association
The association acts through its officers and agents. The board of directors makes the policies for the association, but the officers and agents carry out these policies and administrative functions for the community. Some of the officers are clerical while others carry out substantive functions based on policies established by the board of directors. All of the officers have an affirmative obligation to act with utmost good faith towards the association and cannot deal in the funds or the property of the association to their own self advantage. Each association typically has a president, secretary, and treasurer and may have one or more vice presidents. However, an association may officially conduct its business with fewer officers than these, depending upon the laws of a given state.
PRESIDENT
The president of an association is vested with all the powers generally given to the chief executive officer of a corporation. While specific by-law provisions may vary the president's duties, it is generally presumed that he or she will preside at all meetings of the board and the membership. The president will execute contracts, orders and other documents in the name of the association as its agent. When signing documents, the president should indicate the capacity in which he or she is signing in order to avoid any personal liability since the president's signature, under most circumstances, will bind the association under a doctrine of inherent powers.
The president also assumes general charge of the day-to-day administration of the association and has the authority to order specific actions in furtherance of the board's policies. The president serves as spokesman for the board of directors in most matters relating to general association business. Like all officers of the association, the president has an affirmative duty to carry out the responsibilities of the office in the best interests of the association. Unless otherwise specified in governing documents, the president serves at the will of the board of directors and can be removed with or without cause at any time by a majority of the full board.
VICE PRESIDENT
The vice-president is vested with all the powers which are required to perform the duties of the association president in the absence of the president. The vice president does not automatically possess inherent powers to act in the capacity of the chief executive officer, and may act for the president only when the president is actually absent or otherwise unable to act. The vice-president may assume such additional duties as are defined by the board of directors. Often, the vice-president will chair one or more substantive committees like that of architectural review.
SECRETARY
The secretary of the association is responsible for keeping and maintaining a record of all meetings of the board and the membership and is the custodian for most of the official records of the association. The position of secretary is not simply a clerical position. In many cases, the secretary will not actually keep the minutes of the meetings, but will be responsible for obtaining someone who will do so as a recorder or assistant secretary. As the custodian for the minutes and other official records of the association, the secretary is responsible for insuring access to those records by the members of the association and their authorized representatives.
TREASURER
The treasurer is the custodian of the funds, securities and financial records of the association. When the association has a manager or management company that actually handles the funds on a daily basis, the treasurer's duties will include overseeing the appropriate people to insure that the financial records and reports are properly kept and maintained. Unless the by-laws otherwise specify, the treasurer is responsible for coordinating the development of the proposed annual budget and for preparing and giving the annual financial report on the financial status of the association.
The treasurer does not have the authority to bind the association or the board of directors in dealings with third parties unless the board has provided express authority for the treasurer to do so. As with the association's secretary, the treasurer does not have to perform the day-to-day record keeping functions of the association when this responsibility is transferred to a management company, but the treasurer will ultimately be responsible for insuring that the financial records of the association have been maintained properly in accordance with sound accounting practices.
Fiduciary Relationship and Responsibility
The members of the board of directors and each officer of the association have a fiduciary relationship with the members of the association. This fiduciary relationship imposes obligations of trust and confidence in favor of the corporation and its members. It requires the members of the board to act in good faith and in the best interests of the members of the association. It means that board members must exercise due care and diligence when acting for the community, and it requires them to act within the scope of their authority.
The fact that the association is a not-for-profit corporation, or that the members of the board are volunteers and unpaid, does not relieve them from the high standards of trust and responsibility that the fiduciary relationship requires. When a member accepts a position on the board of directors, he or she is presumed to have knowledge of the duties and responsibilities of a board member. Board members cannot be excused from improper action on the grounds of ignorance or inexperience and liability of board members for negligence and mismanagement exists in favor of the association and the property owners.
Each board member must recognize the fiduciary relationship and the responsibilities that the board has to the association and each of its members. The board's duties must be performed with the care and responsibility that an ordinary prudent person would exercise under similar circumstances, and the ultimate responsibilities of these unique positions cannot be delegated to a manager, a management company or other third party.

Acting through the board as a whole, a board member should:
Enforce the documents
Establish sound fiscal policies and maintain accurate records
Develop a workable budget, keeping in mind the needs, requirements and expectations of the community
Establish reserve funds
Act on budget items and determine assessment rates
Collect assessments
Establish, publicize, and enforce rules and penalties
Authorize legal action against owners who do not comply with the rules
Review local laws before passing rules or sending bylaws to membership for approval
Appoint committees and delegate authority to them
Select an attorney, an auditor, insurance agent and other professionals for the association
Provide adequate insurance coverage, as required by the bylaws and local governmental agencies
Inform board members of all business items that require their vote
Inform members of important board decisions and transactions
See that the association is protected for the acts of all parties with fiscal responsibilities
Attend and participate at meetings
Operating a homeowner association carries with it many of the very same duties and responsibilities as overseeing any other business. Serving as a board member is a valuable and rewarding experience that should be undertaken by those who see it as an opportunity to serve their fellow neighbors while protecting and enhancing the assets of the community. The Role Of Today's HOA
Board Of Directors
To be effective, a homeowners association needs a strong board of directors that understands its role and pursues it with passion and a concise mission in mind. The following outline provides an overview of board roles and responsibilities.
To form an effective board, directors must have a clear understanding of the strengths and weaknesses of the association, its history and what is to be accomplished. Every homeowner association should have responsibility for its assets as well as its operation in accordance with standards established by state and federal law, local ordinances, and the governing documents upon which the entity itself was created. To the extent that the association has such authority and control, it is the board of directors that makes certain these responsibilities are fulfilled.
Understanding the homeowners association concept:
The homeowners association is the cornerstone of a planned residential community. It brings continuity and order to the community, it preserves the architectural integrity and it maintains the common elements. Properly run, the association promotes the concept of “community” and protects the neighborhood's property values. In many cases, it collectively makes available recreational and other facilities that might not otherwise be affordable or available to homeowners and residents on an individual basis.
Deed-initiated homeowners associations have become an essential part of the overall concept of residential property ownership in today's marketplace. Purchase of a home or lot often brings with it mandatory membership in an association which then provides the structure for operation and management of the residential development. With membership comes certain maintenance obligations, financial responsibilities, and a commitment to abide by use restrictions and other rules of the association. To a degree, it necessitates individual conformity for the good of the whole.
The association's responsibilities may be limited to basic maintenance functions or they may be expanded to include sophisticated and extensive upkeep of the property as well as delivery of special services to individual homes (e.g. back door trash pickup). To be successful, its officers and directors must uniformly and fairly govern the community, and it must have a reasonable level of participation by each of its members over time.
Board of Directors
The association has responsibility for its common elements as well as the management and operation of the association's business affairs - - all in accordance with standards established by the governing documents created when the community was first developed. To the extent that an association (typically a non-profit corporation) has such authority and control, it is its board of directors that carries out these duties and responsibilities.
Members of the board of directors of an association serve without compensation unless the bylaws of the association provide to the contrary. The board's authority includes all of the powers and duties enumerated in general law, as long as these powers are not inconsistent with the provisions of the documents governing the association.
Officers of the Association
The association acts through its officers and agents. The board of directors makes the policies for the association, but the officers and agents carry out these policies and administrative functions for the community. Some of the officers are clerical while others carry out substantive functions based on policies established by the board of directors. All of the officers have an affirmative obligation to act with utmost good faith towards the association and cannot deal in the funds or the property of the association to their own self advantage. Each association typically has a president, secretary, and treasurer and may have one or more vice presidents. However, an association may officially conduct its business with fewer officers than these, depending upon the laws of a given state.
PRESIDENT
The president of an association is vested with all the powers generally given to the chief executive officer of a corporation. While specific by-law provisions may vary the president's duties, it is generally presumed that he or she will preside at all meetings of the board and the membership. The president will execute contracts, orders and other documents in the name of the association as its agent. When signing documents, the president should indicate the capacity in which he or she is signing in order to avoid any personal liability since the president's signature, under most circumstances, will bind the association under a doctrine of inherent powers.
The president also assumes general charge of the day-to-day administration of the association and has the authority to order specific actions in furtherance of the board's policies. The president serves as spokesman for the board of directors in most matters relating to general association business. Like all officers of the association, the president has an affirmative duty to carry out the responsibilities of the office in the best interests of the association. Unless otherwise specified in governing documents, the president serves at the will of the board of directors and can be removed with or without cause at any time by a majority of the full board.
VICE PRESIDENT
The vice-president is vested with all the powers which are required to perform the duties of the association president in the absence of the president. The vice president does not automatically possess inherent powers to act in the capacity of the chief executive officer, and may act for the president only when the president is actually absent or otherwise unable to act. The vice-president may assume such additional duties as are defined by the board of directors. Often, the vice-president will chair one or more substantive committees like that of architectural review.
SECRETARY
The secretary of the association is responsible for keeping and maintaining a record of all meetings of the board and the membership and is the custodian for most of the official records of the association. The position of secretary is not simply a clerical position. In many cases, the secretary will not actually keep the minutes of the meetings, but will be responsible for obtaining someone who will do so as a recorder or assistant secretary. As the custodian for the minutes and other official records of the association, the secretary is responsible for insuring access to those records by the members of the association and their authorized representatives.
TREASURER
The treasurer is the custodian of the funds, securities and financial records of the association. When the association has a manager or management company that actually handles the funds on a daily basis, the treasurer's duties will include overseeing the appropriate people to insure that the financial records and reports are properly kept and maintained. Unless the by-laws otherwise specify, the treasurer is responsible for coordinating the development of the proposed annual budget and for preparing and giving the annual financial report on the financial status of the association.
The treasurer does not have the authority to bind the association or the board of directors in dealings with third parties unless the board has provided express authority for the treasurer to do so. As with the association's secretary, the treasurer does not have to perform the day-to-day record keeping functions of the association when this responsibility is transferred to a management company, but the treasurer will ultimately be responsible for insuring that the financial records of the association have been maintained properly in accordance with sound accounting practices.
Fiduciary Relationship and Responsibility
The members of the board of directors and each officer of the association have a fiduciary relationship with the members of the association. This fiduciary relationship imposes obligations of trust and confidence in favor of the corporation and its members. It requires the members of the board to act in good faith and in the best interests of the members of the association. It means that board members must exercise due care and diligence when acting for the community, and it requires them to act within the scope of their authority.
The fact that the association is a not-for-profit corporation, or that the members of the board are volunteers and unpaid, does not relieve them from the high standards of trust and responsibility that the fiduciary relationship requires. When a member accepts a position on the board of directors, he or she is presumed to have knowledge of the duties and responsibilities of a board member. Board members cannot be excused from improper action on the grounds of ignorance or inexperience and liability of board members for negligence and mismanagement exists in favor of the association and the property owners.
Each board member must recognize the fiduciary relationship and the responsibilities that the board has to the association and each of its members. The board's duties must be performed with the care and responsibility that an ordinary prudent person would exercise under similar circumstances, and the ultimate responsibilities of these unique positions cannot be delegated to a manager, a management company or other third party.

Acting through the board as a whole, a board member should:
Enforce the documents
Establish sound fiscal policies and maintain accurate records
Develop a workable budget, keeping in mind the needs, requirements and expectations of the community
Establish reserve funds
Act on budget items and determine assessment rates
Collect assessments
Establish, publicize, and enforce rules and penalties
Authorize legal action against owners who do not comply with the rules
Review local laws before passing rules or sending bylaws to membership for approval
Appoint committees and delegate authority to them
Select an attorney, an auditor, insurance agent and other professionals for the association
Provide adequate insurance coverage, as required by the bylaws and local governmental agencies
Inform board members of all business items that require their vote
Inform members of important board decisions and transactions
See that the association is protected for the acts of all parties with fiscal responsibilities
Attend and participate at meetings
Operating a homeowner association carries with it many of the very same duties and responsibilities as overseeing any other business. Serving as a board member is a valuable and rewarding experience that should be undertaken by those who see it as an opportunity to serve their fellow neighbors while protecting and enhancing the assets of the community. It is serious business, but also a task worth doing well in order to safeguard the investments of all.

A corporate attorney sent the following out to the employees in his company:> > 1.... Do not sign the back of your credit cards. Instead, put 'PHOTO ID REQUIRED.'> > 2. When you are writing checks to pay on your credit card accounts, DO NOT put the complete account number on the 'For' line. Instead, just put the last four numbers. The credit card company knows the rest of the number, and anyone who might be handling your check as it passes through all the check processing channels won't have access to it.> > 3. Put your work phone # on your checks instead of your home phone. If you have a PO Box use that instead of your home address. If you do not have a PO Box, use your work address. Never have your SS# printed on your checks. (DUH!) You can add it if it is necessary. But if you have It printed, anyone can get it.> > 4. Place the contents of your wallet on a photocopy machine. Dear Homeowners,
The annual meeting of Catalina Oaks Home Owners’ Association was held at the Rockridge Community Center. It was a rainy cold day and most residents stayed home. Our President called the meeting to order Saturday January 9, 2010 at 3:00 PM.
The Agenda is shown and a few notes are posted within the agenda. Additional detail is presented in section 2 herein.

1. This is the annual meeting for 2010 of the members of the Catalina Oaks Homeowners’ Association. The COHA President, John Kone, called the meeting to order.
2. Roll call of directors and confirmation of a quorum. President John Kohn, Vice President Dick Byram, Treasurer Jean Kay, Bob Scully Secretary and Alternate Pat Estelle. All present.
3. Count names on attendance list and proxies to establish quorum. Thirty percent (30%) of the members are a quorum. Thirty percent of 52 members are 16. Note that there is a quorum or lack of. There was a lack of a quorum.
4. President asks the Secretary to read the minutes of the last meeting. Any corrections? If not, minutes stand as read. Minutes were read and stand as read.
5. Treasurer’s report for the year 2009. Jean distributed a hand written summary. Details are noted in section 2. Motion to accept as read. Accepted. The Treasurer reports that the IRS has been satisfied before the deadline of April 15, 2009. No discussion. The President announces that the Annual Report has been submitted to the Secretary of State of the State of Florida. No discussion.
6. The President announces that there are no outstanding issues between Catalina Oaks Homeowners’ Association and the County. No discussion.
7. Distribute new budget for 2010. Jean handed out a proposed budget. Review of financial statement and proposed budget for 2010. A financial accounting by month was not available at the meeting. Motion to accept the budget. Accepted Discussion and vote on the budget. No discussion
8. Nominating Committee introduces the nominees: The term of office for all nominees is for the calendar year of 2010 and until the annual meeting scheduled for January 2011 as dictated by the governing documents. No action
9. President asks if any nominations from floor. If any, nominee should stand, be asked if willing to serve if elected. President will ask for two volunteers to count ballots. Members will vote for or against a nominee. A nominee must acquire a simple majority of the votes cast. No new nominees
10. Ballot count if one was taken. Announce the names of those elected to the board. The existing board stands.
11. President will adjourn the meeting. Meeting adjourned.

1. Minutes - Meeting minutes for today’s meetings are included herein and will be posted on the blogspot.
2. Finances - Jean Kay provided a summary of the Catalina Oaks finances. Total assets as of January 8, 2010 are $110, 839.09 (CDs and checking account). The CDs mature in May 28, 2010 and July 6, 2010.
A handful of homeowners are behind on association dues. The total amount is $685. Jean is working the action to collect with the individuals in arrears. There was discussion about putting liens on property for non-payment of dues. Jean has been successful in collecting dues without going to that extreme. The board understands that the lean process is an alternative and it will go down that road when it becomes necessary.
The expenditures by month data were not available at the meeting. Jean will provide a handwritten data sheet next week. I will include it on an excel spreadsheet and include it in the blog for the homeowners to view.
A comment was made that financial information should not be posted on the blog for the world to see. The board is evaluating the comment and will decide how to proceed accordingly.
3. Grounds Maintenance - Our grounds maintenance needed improvement and a decision was made last year to give the maintenance to John Smith, on a trial basis. His work has been great. The board issued a Christmas bonus of $100 to both John and Larry.
After considerable discussion the board to increase the grounds maintenance fee by $50, which coincides with a scope of work adjustment to include grounds maintenance at the entrance hedge, near the mailbox. This will commence in January 2010.
5. Email Addresses – The board needs more email addresses of homeowners so we can get the word out as required.
6. Landscape Change – It was requested that the area where we have wood borders be changed to brick. The board approved the action and Dick will make the change.
7. Wall paint – It seems that there is 2 different shades of paint at the corner wall (10th and 6th). Dick suggested we buy another 5 gallons of the right color so as to match the rest of the wall. He was going to get with Robert to repaint the specific area at NO charge, as we would provide the paint. The board approved.
8. Drainage concern – Dick outlined a concern about the drainage cistern at the southeast corner of the development property. He will evaluate the potential leak further and take the necessary action to correct it.
9. Meetings - The board recommends that the homeowners attend these meetings, as it is your community. There are 2 meetings to be held January and July. Special board meetings will be scheduled as required to cover issues that may need attention, when necessary. If you have any thoughts about meeting times or dates, please let us know.
10. Homeowners List 2010 - This data was distributed at the meeting. It will be posted to the blog.
11. Letter to the Board - A letter, from Pat Estelle, was read at the meeting and subsequently submitted, and posted on the blog.

To the HOA Board and Residents of Catalina Oaks,
Over five years ago, in a vulgar tirade, Gerald Duhaime falsely accused me of
reporting him to the HOA for a covenant violation. Since that day he has
relentlessly harassed, threatened and slandered me, all without any justification
whatsoever, except that created in his mind and spread to anyone who would
listen. He has violated the sanctity of my home, vandalized my property, and even
placed a Swastika in his front yard, telling the Sheriff that I was the perpetrator.
While there have been literally dozens of other examples of his pernicious
behavior, that alone should irrefutably demonstrate the character of this man.
It was obvious from the start that Duhaime’s goal was to make my life miserable, to
destroy my reputation and to drive me from my home. His behavior is akin to that
of a juvenile delinquent who has no sense of decency and no way to express himself
beyond the liberal use of four-letter words and the middle finger. Many of you have
experienced this first-hand. As for my reputation, it is solidly in tact among those
whose opinions I respect. A few still believe his pathological lies, but anyone with a
shred of integrity acknowledges the truth. He will never drive me from my home.
The Sheriff has made it abundantly clear that he is eager to step in and take action
should that become necessary and I have retained an attorney with the intent of
taking legal action in civil court. He has stated I have a strong case.
I present this letter to the board simply to expose what has festered in the shadows
for too long and to highlight Duhaime’s chronic violation of the HOA covenants
and County codes. When cited, he always blames me as the source of his problems,
never taking any responsibility for his actions. It is always someone else’s fault. All
of us in the community have been held to the standards set down in the covenants;
this man never is. I hope we will soon see a return to civilized behavior in Catalina
Oaks which has been absent for too long. Whether we do or not is the burden of
one man.

Over five years ago, in a vulgar tirade, Gerald Duhaime falsely accused me of
reporting him to the HOA for a covenant violation. Since that day he has
relentlessly harassed, threatened and slandered me, all without any justification
whatsoever, except that created in his mind and spread to anyone who would
listen. He has violated the sanctity of my home, vandalized my property, and even
placed a Swastika in his front yard, telling the Sheriff that I was the perpetrator.

Happy New Year and a Meeting Reminder
Happy New Year from the board to all of you.
Its that time of year again and we thought we would remind you about the meeting (Annual Catalina Oaks Homeowners) next weekend at the Rockridge Communtiy Center at 3:00 Saturday January 9. If you can't make the meeting please send in or hand to any member of the board the proxies that were hand delivered in December 09. Thank You
As is customary the minutes will be posted on this site a week after the meeting.
The next meeting will be held in July. A specific time and date will be decided on during the January meeting. The board will call Special Meetings during the year as required to deal with issues that require attention, as they come up.
We wish you all well. Stay healthy, be safe and remember you are part of the community so be involved. Our job is to help you as best we can and your job is to help us help you. And we are always looking for board members.
